Debtor
According to ยง101 (13) of the U.S. Bankruptcy Code, Debtor means the person or municipality concerning which a case under this title has been commenced. The person or entity that files the Bankruptcy is called Debtor for the duration of the Bankruptcy case. A Debtor has the obligation to file the necessary paperwork required in a bankruptcy proceeding. If the Debtor hires an attorney their attorney will file the necessary documents on the Debtor’s behalf. It is important for the Debtor to advise their attorney of everything pertaining to their financial history. The Debtor must be truthful in all of their statements under the penalty of perjury. The attorney for the Debtor can advise them what does and does not need to be provided to the court as situations arise.
