341 Meeting of Creditors
I am going to try to empty my inbox this morning. I have training on Time Matters this afternoon and then have to attend 341 Meetings of Creditors tomorrow, so I have to get a lot of work done this morning. The ยง341 Meeting of Creditors is simply an evidentiary hearing where a creditor has the opportunity to show up and ask some questions regarding their treatment in the plan, etc. It is very seldom that any of them attend. Most often in attendance are the IRS or the Attorney General’s office (for child support arrears). There is the random creditor who will show because they do not understand the process. In our district and division, a Paralegal (with attorney permission) is allowed to represent the Debtor at this meeting. The Paralegal, or attorney, makes notes as to what the Debtor and Hearing Officer discuss and as to whether or not any changes to the plan or schedules are needed prior to confirmation of the case.
