Chapter 13: Release of Auto Titles
I have received several calls from discharge Chapter 13 debtors requesting release of lien titles. Many of these titles are being mailed to debtors that have moved and the creditor did not confirm if address was correct. Best case is for the creditor to mail all the titles to office of the Debtor Attorney to be forwarded to debtor. Sending creditor a 10-day title demand letter is rarely effective because most creditor addresses listed in Chapter 13 plan from 36 to 60 months prior have changed and a large portion of the letter are returned mail.
