Refiling Bankruptcy after previously receiving Discharge.
If you have previously discharged Chapter 7 or 13 bankruptcy case then you must wait 8 years before you can receive a discharge in another bankruptcy case.
For exampled, if you received a Chapter 7 discharge on 06/12/1999 then you would not be eligible to receive discharge in another case until 06/12/2007. If you file a bankruptcy as Chapter 13 and plan is set for 5 years before discharge then the Chapter 13 Trustee and U.S. Trustee will likely have no objection. However, if you attempt to file another Chapter 7 bankruptcy case that would discharge prior to 06/12/07 then the U.S. Trustee will file objection.
In short, you must report any previously file bankruptcy when considering filing another bankruptcy case.
