IRS Refund while in Bankruptcy
This is the fund time of year where everyone is getting their refunds from the IRS. Other issues arise as well. I have received several calls from Debtors stating that they have not received anything about their tax returns the whole time they have been in bankruptcy. We then have to call the IRS and find out what is going on. When you are in bankruptcy the refunds have to be released manually by the IRS.
The one thing that makes me really frustrated is one particular Debtor that out and out told me that I was giving him the run around and he did this via email, not even in person or over the phone. The reason why it makes me made, one is because he told me that he hasn’t received any of my responses to his emails. This is when it all started with him. I told him that I have replied to his emails as soon as I get them. He still stands by his word and says he hasn’t received them. So, I printed the replied emails and mailed them to him with a cover sheet to provide me with a fax number or I will be sending responses to him via regular mail. He hasn’t provided me with a fax number, so I will start sending responses to him via mail.
The other problem he has is purchasing a car. I requested updated pay stubs and expenses for me to look to make sure it would be approved, but he has neglected to provide this to me. He believes that a Judge will not grant him the money to purchase a car. I am going to send him a letter on top of the message I left for him already to make it clear to him that he is going to lose my help if he doesn’t stop and begin to become patient. Things don’t happen over night.
