Leasing Property and Bankruptcy

Many people are confused about how lease property works with these Aaron places or Rent-A-Center places. If you let your attorney know that you have some type of lease contract with one of these places and you are filing a chapter 13, you will have to continue making payments outside of your plan to the creditor or they will want to get their collateral back (whatever this may be). Under the bankruptcy laws, they can not contact you, it is a violation of the protection you have, and they would need to go through your attorney’s office to do so, let them know what is going on so they can get with you.

I had an incident yesterday, they told me they could call, and I had to argue with them, and told them if they don’t stop the calls, then we will pursue further action for the violation of the stay. I spoke with the manager and he stated he tried to call us, left messages, but never received a call back. He couldn’t tell me where the message was left, just a random voicemail and I asked if he tried faxing us or mailing us and said that he didn’t have the fax number, but did not comment on the mailing. Told him he can’t call her any more, he needs to go through our office.

These things are difficult at times, but if you let your attorney know what is going on first hand, then it may become easier to understand and know how they need to handle the situation.
