I. R.S. Wage Levy
If you have I.R.S.wage levy when you file Chapter 13 then the I.R.S. will immediately be contacted to advise them of your bankruptcy filing. If filing a Chapter 13 bankruptcy then the amount you owe will be provided for in bankruptcy plan for repayment to the I.R.S.
If you are in active bankruptcy and receive “Notice of Wage Levy” from the I.R.S then contact your Attorney’s office. Your attorney will contact the I.R.S. to ensure the wage levy is released. Any funds garnished from check by the I.R.S. can be refunded back to you. This process takes about 30 days. The wage levy is a violation of the automatic stay in place while in active bankruptcy.
