Listing All Creditors when Filing a Bankruptcy Case

It is very important that you list all of your creditors when you file for a bankruptcy. When you file for a Chapter 13 bankruptcy, you have to make sure that you have all of your creditors listed. If you neglect to list all of your creditors, then you will have problems when you get done with the case. The purpose of filing for bankruptcy is to make sure you list everyone you owe so you can get back on your feet. If you fail to list one, then that creditor is not considered discharged with the other debt.

You can add creditors to a Chapter 13, but there is a time limit. You can only add them up to three months after filing. You will have to check with your attorney’s office to find out what they charge to add the creditors. There are court fees that are associated with that.

In a chapter 7 bankruptcy, if you neglect to list a creditor, it is known that the debt is still discharged. It is still important to make sure that you list all your creditors and make sure that if you have to add any, you do so within the certain time frame.
