Debtor Education After Filing Bankruptcy
Once a case is filed there is another course that has to be taken for a Debtor to receive their discharge. This course is the Debtor education course and it is required for every Debtor that files, whether it is a Chapter 7 or a Chapter 13. For a chapter 7 it is required to be taken within 45 days from your meeting of creditors. You can take this course prior to the meeting of creditors if you would like and get it out of the way. The most important thing is to get the course taken prior to the last day for creditors to complain to the discharge ability of their debt. In a Chapter 13 case, the trustee provides a class or seminar that you attend on the day of your meeting. The course is given in the morning before you attend your meeting of creditors. This course for a Chapter 13 is necessary to be completed prior to discharge, so you could wait until you get closer to discharge, which is about 5 years away, but do you really want to risk forgetting that you have to take this course.
