Notifications After Filing Bankruptcy

When a case is filed, mainly a chapter 13 case, there is generally someone that has to be called and notified of the bankruptcy filing. Most times it is a mortgage company or a car creditor. It is important to keep in mind to call the car creditor when a Debtor has decided to put the vehicle through the plan. The reason why it is critical is because even if they are current on their payment, a payment may come due prior to their trustee payment, which can cause a problem with the creditor picking up the vehicle, because they may not have received the notice via regular mail. Foreclosure scares me at times with all of the chaos that is going on that something maybe forgotten, but I know that someone is here to double check and ensure we got everyone notified. I did have a creditor the other day that refused to take the information over the phone about a client’s bankruptcy. She wouldn’t even give me a fax number. I explained to her that I was going to let the client know that she refused to take the information, so when they continue to call the client, I will have her make a detailed log sheet of when they called, who called, and the number for a return call, so the attorney will can pursue further with a violation of the automatic stay. The purpose of calling people to let them know you have filed is to stop what ever process they have moving forward and they now will have to go through the bankruptcy courts to pursue it further. If you have people calling you and harassing you, take their information down and get it to your attorney immediately.
