Last Call to Stop Foreclosure

Today is foreclosure Tuesday in the State of Texas. Our office was open yesterday, September 3, 2007, to accommodate those clients who, at the last minute, found a solution to their problem. They tried everything on their own to stop their foreclosure sale. They talked with the mortgage company and tried to work something out with them, but they wanted to much. The client is asking “how am I to pay that amount of money when I can’t make my regular monthly payment?” They find themselves wondering, am I able to keep the house I raised my children in? Then for one reason or another, they found out that they could file bankruptcy to stop the foreclosure process. They begin to call attorney’s office to find that there is no one opened, because it is Labor Day. They try to work something out with the attorney’s office that represents the mortgage company, and can you believe it, they give you a name of an attorney that they are sure would be open on Labor to help those people who are in need of saving their home. They call our office, come in, talk with the financial advisor, pay the retainer fee and get their case filed. The foreclosure sale has stopped. It is a scary thing to think that you are on the verge of loosing your home. Some people try up until the very day of foreclosure. Most attorneys will not take your case at such a late time. Most attorneys will have their last call the day prior to foreclosure and in this instance, the Friday before, because most offices are closed for the holiday. What is really scary to me is that everyone that you are trying to notify on, the banks and opposing counsel, are closed. If you have a way to notice them, such in one case where, I just had the fax number, I faxed the notice and then called back the next morning to ensure it was pulled and they got it. If you have notes that they were noticed and the bankruptcy was filed prior to the sale, then they have to stop the proceedings and if they follow through, they have to rescind the foreclosure.

Foreclosure will take place this morning around 10a.m. in most cases, so it is now the last call to get into an attorney’s office and save your home.
