Collections calls after filing Bankruptcy
Once your bankruptcy case is filed then all the creditors listed will be notified of the bankruptcy notice via 1st class mail. You should allow about 7-10 days for the collection calls to cease completely. When you receive the creditor call then you should provide them with the phone number for creditors provided by your attorney’s office. You can let them know you have filed bankruptcy and provide your bankruptcy case number then request to have your account noted.
After 7-10 days from file date, if you are still receiving collection calls and letters then contact your attorney to provide the creditor information. Your attorney will send “Cease and Desist” letter to the creditor. This should stop all contact via phone or mail by the creditor.
If collection efforts continue then this is considered a violation of your automatic stay. You should contact your attorney’s office to provide documented times and dates of the collection calls or provide copies of collection letters so your attorney can pursue filing stay violations against these creditors.
You should not have to tolerate forceful attempts by any of your creditors so if they call then just hang up and contact your attorney.
