Probation Fees and Bankruptcy

An interesting question appeared before me yesterday. A client asked about her husband’s probation fees. He is currently behind on them and they are going to be filing a Chapter 13 and wanted to know if they would be able to include those fees into their chapter 13 plan. That is a great question and I have not had anyone ask me a question like that before. I asked the attorney and he wasn’t a 100% sure, but looked it up to see if such a fee could be included in a chapter 13 plan. He was thinking that since it was a fee that was caused by a criminal act. When he was done looking it up, it was to our surprise that it is a fee that you can include in a Chapter 13 plan. The best way to list this type of debt is to list it as a priority debt, which ensures that the debt will be paid towards the beginning of your bankruptcy.
