Quick Claim Deed your House while in Chapter 13 Bankruptcy

A recent question arose the other day by a client that is in a Chapter 13 bankruptcy. The debtor was trying to find out if he could do a quick claim on his house with his dad’s name on it to help save him some money. While you are in a Chapter 13 bankruptcy, as a Debtor, you must receive permission from the Chapter 13 trustee on many things. From what I learned, a deed would have to be submitted to the trustee for approval.

How do you do that? You would have whomever is working with you get together the needed documents and present it to your bankruptcy attorney. Once your bankruptcy attorney has this information, they will send it to the Chapter 13 Trustee. The turn around on an approval for a letter from the Chapter 13 trustee can take between seven to five business days. Make sure that you have plenty of time to submit all of your information to your bankruptcy attorney to get it to the Chapter 13 trustee for approval.
