Reaffirmation of Debt
When filing a Chapter 7 bankruptcy, you may have secured debts that you will wish to keep and maintain the monthly payments. Your statement of intentions is filed with your Chapter 7 petition and this is the notice to your secured creditors of your intention to reaffirm the debt.
The creditor will prepare and provide a Reaffirmation agreement and mail it to your attorney’s office for your signature. The Reaffirmation agreement states that you wish to continue payments on home or vehicle and this debt will not be discharged as part of Chapter 7 bankruptcy. The reaffirmation agreement is initiated by the creditor, not by your attorney. You should contact your attorney if you have not sign a reaffirmation agreement within 60 days of filing case.
