Making Your First Chapter 13 Payment

After you have submitted all of your paperwork to your bankruptcy attorney, you will meet with the attorney to find out what your payment will be to the trustee. The bankruptcy attorney will give you the payment amount, the due date and where to send the payment to. Your first payment is the most critical payment that you could make. You must make your payment to the Chapter 13 trustee prior to the due date, otherwise the >Chapter 13 trustee will submit a notice to the courts stating that you haven’t made your first payment and they are giving you 48 hours to make the payment.

If you fail to make your first payment to the >Chapter 13 trustee, your case will be dismissed. You will then have to decide if you want to re-file or seek an alternate route, especially if you are unable to make the trustee payment.
