Losing your home
Losing your home is not a choice your want to have to make. Filing a Chapter 13 Bankruptcy in most casse can help you keep your home, If the reason is that you have fallen behind because of loss of income and now you have it back, the chapter 13 will allow you to pay the mortgage company back the money over a five year plan. If the reason is because you can’t afford to make the house payments anymore because of the loss of income or because the house payment has gone up because of the interest rates. Then no the chapter 13 will not help, It can’t force the mortgage company to lower the interest back to were they were. If your home is foreclosed on then the best thing for you to do is to file a chapter 7 bankruptcy. The chapter 7 is a discharge of unsecured debts which is what the house has become after the foreclosure sale. By filing the chapter 7 as long as your making money again and paying bills buy another home should be possible over the next couple years.
If any of these thing are going on you should talk to a Bankruptcy Attorney to see how a bankruptcy could help you.
