Can anyone file Bankruptcy?

The answer is yes, if you can legally incur debt then you can use a bankruptcy to deal with it. The chapter 7 Bankruptcy is use to deal with unsecured debts, You have to qualify to do this. Meaning not making too much money or having assets that can not be protected. The chapter 13 bankruptcy is used to help people that have fallen behind on their home or car, But for some they make too much to file a chapter 7 bankruptcy so they go into a plan to pay the unsecured creditors some money over a five year plan. The chapter 11 is mainly used for business but if you make a several hundred thousand dollars a year and or have more than 930,000 in property or more than 330,000 in unsecured debts these amount are too large for a chapter 13 and would receive the same benefits as the 13 but doing it through the chapter 11.
So yes just about everyone can file a bankruptcy But you need to talk to a bankruptcy attorney to see which will help you the best.
