Chapter 13: Meeting of Creditors

Once your Chapter 13 bankruptcy is filed there is a hearing that you must attend. You will receive a notice in the mail regarding this hearing and it can be confusing. The Chapter 13 meeting of creditors’ notice that the bankruptcy courts mail out has a time of 2pm, but you actually have to be there about 7:45am for the morning portion. In the morning, there is a Chapter 13 seminar, which is required by the courts to receive your discharge. The Chapter 13 trustee will give you a certificate for the completion of this course, and in turn, you must give this to your bankruptcy attorney to file with the courts.

Failure to attend this meeting can cause the dismissal of your case. Most times if there is a good reason for you missing the original meeting of creditors, the Chapter 13 will reset, but only will reset it once. If you fail to make it to the second hearing, your case will be dismissed and there really isn’t much you can do, but to re-file.
