Converions from a Chapter 13 to a Chapter 7

When you have been in your Chapter 13 bankruptcy for a while and you decide you can’t afford it any longer, you must contact your bankruptcy attorney to see what our options are.

If you can convert to a Chapter 7 bankruptcy, in most cases, you must pay attorney fees to convert the case. You also have to provide your last six months pay stubs, to ensure that you can’t pay any of your creditors back. Recently we found out that it is not necessary to file the means test once a case is converted to a Chapter 7 bankruptcy unless the trustee requests it to be filed. To be safe, you should always run the means test to ensure that the Debtor qualifies to convert to a chapter 7 bankruptcy.
