Chapter 7

Chapter 13
You can file for bankruptcy under Chapter 13, if you have a regular and secure source of income and desire to repay your loans in a systematic manner. Corporations and partnerships cannot file for Chapter 13 bankruptcy.

While filing the petition, you must submit to the court:

  1. a comprehensive list of all your debts, with details of the respective creditors,
  2. a thorough compilation of your property and assets,
  3. a summary of your day-to-day living expenses, and
  4. a repayment plan for a period of three to five years.

The court will approve this plan, if there is no objection from any of the creditors, and appoint a trustee to oversee the repayment.
