Chapter 7
Chapter 7 offers straight bankruptcy, which means that after your unsecured debts are discharged, the remaining debts will be repaid after the liquidation of your non-exempt assets.
Debts which the law defines as non-dischargeable are:
Study loans
Alimony
Personal injury compensation
Child support
Taxes
Fines imposed by the government for breach of laws
Debts not mentioned in your bankruptcy petition
Debts owed due to fraud, embezzlement or larceny
You are allowed to retain assets like a homestead of specified worth, pension benefits, gains from insurance claims, wages, tools of your trade, some personal miscellaneous items and personal injury claims.
Chapter 13
If you have a steady income, you can file for Chapter 13 bankruptcy, whereby you can repay your debts according to a structured plan. You must submit a record of your finances, list of debts with particulars, details of your monthly living expenses and a repayment schedule for a period of three to five years, to the court. The court will approve this plan subject to the creditors’ opinion, and appoint a trustee to supervise the repayment plan.
Chapter 13 allows you to retain most of your property, but to understand its details it is better to consult a bankruptcy attorney.
Our bankruptcy attorneys offer their services to the residents of Oklahoma City, as well as other cities like Tulsa, Midwest City and Buffalo.
